Reason for Opposition to HB 1794:
HB 1794 bill is basically a ban on abortion, recognizing personhood of child, etc.  Of course ending abortion here in Missouri and nationally is the goal for Missouri Right to Life.  I would not call it a personhood bill as its worded differently than other personhood attempts.  First some background information.

Recently a bill called  “the heartbeat bill,” another ban on abortion (from South Dakota I believe,) was overturned in the lower courts and remanded back to the lower courts by the US Supreme Ct (in other words, they refused to hear it.)   That tells us that the majority of the US Supreme Court is not in favor of banning abortion/overturning Roe v Wade at this time. (Something we already knew from previous Supreme Ct. decisions.) And, of course now with the death of Justice Scalia the pro-life numbers on the Supreme Court are even smaller.

The problems with this bill are two-fold.  First, it repeals the Missouri statute, 1.205 which states “…The life each human being begins at conception…” and goes on with other declarations about the unborn child. HB 1794 repeals the current language and adds additional language about the child being “…hereby deemed a person…”  Mo Statute 1.205 was  part of  the language of HB 1596 (passed in 1986 and upheld in 1989) and that part of HB 1596 was never challenged in court so has never been overturned or upheld.  It is just superseded by Roe v. Wade when it comes to abortion.

If HR 1794 is overturned as we believe it will be by this present US Supreme Court, it could also overturn our statute 1.205.  That statute, while it has been superseded by Roe when it comes to abortion, has been used by the Missouri courts to convict persons of  two deaths in a manslaughter case because they have attacked pregnant women or caused traffic accidents in which an unborn child died.  We have offered a safety amendment to the bill that would protect our statute and while the supporters of 1794 showed some interest in that a few weeks ago, they have not contacted us since. If the safety clause was added, we would go neutral on the bill because of the second reason below. 
           
The second reason for opposing this bill is that again we believe that the bill will be overturned by the US Supreme Ct (and overturned by every other lower court on its way to the SCOTUS. )  In the overturning decision, they may very well reaffirm Roe v Wade as they did in the Casey decision in 1992.  Every time this reaffirmation happens, it just makes it harder for us to overturn Roe in the future. 
           
If we ever hope to overturn Roe and ban abortion here in Missouri we must elect pro-life Presidents and US Senators that will appoint and approve pro-life US Supreme Court justices.

Update on Legislation Passed in 2014:
The "Show-Me Healthy Babies Program" was created in 2014 by the Missouri House and Senate to provide insurance for pregnant women who earn too much to qualify for traditional Medicaid but don't have affordable private-sector insurance.  The plan was recently approved by the federal Centers for Medicare and Medicaid Services

Through the Show-Me Healthy Babies Program, pregnant women with incomes up to 30% of the federal poverty level will have access to pregnancy-related services that promote healthy labor, delivery and birth.  Women participating in the program will have postpartum coverage for sixty days.  Coverage for the child will continue for up to one year after birth.

The MO HealthNet Division, which operates the state’s Medicaid system, began accepting online applications for the Show-Me Healthy Babies Program on January 1, 2016.  If you know a woman who can benefit from this program, you can share the following information regarding how to apply for the Show-Me Healthy Babies Program.  This program will help a woman choose life for her unborn child and help her and her unborn child get off to a healthy start in life. .  The program is expected to expand access to health care to an estimated 1,800 pregnant women each year.
